Terms of Service

These Terms govern the contractual relationship between DuyTec GmbH ("Provider") and the user ("Customer") regarding the use of the DataFly application ("Product") and its subscriptions.

2. Service Description

DataFly is a peer-to-peer file transfer app for iOS and Windows. Files are transferred directly between users' devices; file contents are not routed through the Provider's servers.

The Provider offers DataFly in three tiers – Free, Basic, and Pro – with different limits on the number of registered devices, concurrent transfers, and favorite contacts. The applicable limits are listed in the app and on the website.

3. Pricing and Duration

Paid tiers are offered as auto-renewing subscriptions. Available plans are Basic Monthly, Basic Yearly, Pro Monthly, and Pro Yearly.

The applicable prices including statutory VAT are shown in Apple's payment sheet before the order is confirmed. The term is one month or one year depending on the selected plan.

4. Automatic Renewal

Subscriptions renew automatically for the selected term (one month or one year) unless cancelled at least 24 hours before the end of the current period.

Charges for renewals are billed to the Customer's Apple ID payment method 24 hours before the renewal date.

5. Cancellation

The Customer may cancel the subscription at any time via iOS Settings: Settings → Apple ID → Subscriptions → DataFly.

In-app cancellation within DataFly is not available per Apple's policy. Cancellations take effect at the end of the current billing period; pro-rata refunds are not provided.

6. Refunds

Refunds for subscriptions purchased via Apple are handled exclusively by Apple in accordance with their applicable refund policy. The Provider has no control over Apple's refund decisions.

7. Limitation of Liability

The Provider is not liable for indirect damages, data loss, or lost profits arising in connection with the use of DataFly. Liability for damages resulting from injury to life, body, or health, and for damages caused by gross negligence or intent on the part of the Provider or its agents, remains unaffected.

The Provider does not warrant continuous availability of the service. Planned maintenance will be announced in advance where possible.

8. Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is – to the extent permitted by law – the registered seat of DuyTec GmbH in Nienburg.
